PROCUREMENT LAW AND PUBLIC CONTRACTS

The Danish government's CSR Action Plan from May 2008 implies that it is not only businesses that must focus on the development of CSR, but also Denmark – as a state – that must contribute. In light of these objectives, a number of state-owned or operated institutions will adopt the United Nations Global Compact principles of social responsibility.

In the future, it is envisaged that the state will have many opportunities to influence social responsibility, for example by choosing and promoting ‘green’ procurement.

CSR is likely to form an integral part of public contracts and also create challenges for public tendering procedures – creating obligations for both the contracting bodies, who must observe the principles of equal treatment and transparency, and for the tenderers, who must live up to and compete on the terms of the tender documents.

Our assistance

When Kromann Reumert's CSR group advises business entities in their role as tenderers, our contribution includes quality assuring the contents of the offer and maximising compliance with the terms of the tender – for example, by ensuring that there is a focus on anti-corruption programmes. 

We also help businesses reflect the particular governmental requirements in their offer, to optimise the chances of being awarded a share of state (and other public) contracts.
