New rules on employee representation

The article describes the new rules of the Danish Companies Act on employee representation, focusing on the most significant changes made to the former rules, which had remained unchanged since 1993. The new rules include possibilities for derogation by agreement between the management and employees, participation by employees of foreign subsidiaries in the election of group representatives, direct election of employee representatives at the group level, and several possibilities for increased flexibility. The Danish Commerce and Companies Agency has recently published a detailed executive order on election procedures, etc., which is discussed in detail in the article.
